    TERMS AND CONDITIONS



    1. OBJECTIVE


    Provide the policies, conditions and terms of the room reservation purchased at the ROSALES PLAZA BOGOTÁ HOTEL, in compliance with internal guidelines and applicable legal provisions.



    2. REACH


    Applies to the client who has purchased an individual accommodation reservation (rooms) at the HOTEL ROSALES PLAZA BOGOTÁ.



    3. GENERAL



    3.1. Check In (admission to the hotel) and Check Out (exit from the hotel) policy: Your reservation begins at 3:00 p.m. on the day of arrival and ends at 1:00 p.m. on the day of arrival. day of exit.



    3.2. Cancellation and Modification Policy: You may cancel or modify your reservation(s) according to what is established in the rate or plan purchased, in case you do not make use of your reservation and have not canceled or modified it within the established time , you will be charged a penalty for the value of the first night of accommodation plus taxes and additional services reserved. Does not apply to non-refundable rates.



    3.3. Minor Registration Policy: If you are traveling with your child(ren) under 18 years of age, you must present the identification document of the minor(s) (civil registration), that proves the existence of kinship. If the minor(s) does not travel in the company of their parents, you must deliver at the reception, in addition to the minor's identification document (civil registry), the permission of the parents, which must be be authenticated by a Notary and accompanied by a copy of the identification document of those who gave the authorization. Without this documentation, minors are not allowed to enter the hotel. The foregoing in development of the provisions of Law 679 of 2001 Statute to Prevent the Sexual Exploitation of Boys, Girls and Adolescents and its concordant regulations.


    3.4. Early Check In Policy:

    b. Entry before 8:00 a.m. The entire night is charged, granting breakfast if the rate for the following days includes it.


    c. Income between 8:00 a.m. and 12:00 p.m. Half the rate acquired during your stay is charged, granting breakfast in the event that the rate for the following days includes it and is within the hours of service provision.


    d. After 12:00 p.m. The entrance to the room is granted as an attention by the Hotel, without breakfast.



    3.5. Early Departure Policy


    to. Inform your early departure one day in advance of the new departure date, so that the hotel can have the room available for sale.


    b. In case of not obtaining information, it will be subject to the charge of the nights to the guest.


    c. 100% of the nights not used in periods of High Season will be charged.



    3.6. Late Check Out Policy


    to. Subject to availability.


    b. Late check out until 3:00 p.m. (3:00 p.m.) without charge.


    c. Late check out between 3:00 p.m. and 7:00 p.m. will be charged half the rate purchased during the guest's stay.


    d. Late check out after 7:00 p.m. (7:00 p.m.) will be charged the full rate purchased during the guest's stay.


    3.7. Relocation policy: If the HOTEL is unable to comply with a reservation accepted in writing, or is forced to terminate the accommodation early, it must obtain accommodation for the GUEST in another establishment of a similar rate, if the rate of the substitute hotel is lower, the HOTEL will refund the difference to the GUEST, if it is higher, the HOTEL will assume the difference.



    3.7. Sustainability Policy: At the HOTEL ROSALES PLAZA BOGOTÁ, we are committed to the sustainable development of our environment, assuming the legal commitment in environmental, sociocultural and economic aspects. We have implemented a mechanism to protect the physical and moral integrity of children, adolescents and vulnerable populations, applying security and control measures aimed at preserving their rights. The exploitation and abuse of minors in Colombia constitute punishable conduct, in accordance with the provisions of the Criminal Code, Law 679/01, to support the above, all our employees have signed a code of conduct on this matter.



    Likewise, it is reported that the trafficking and commercialization of species in danger of extinction is considered illegal in Colombia and is penalized (Resolution No. 0572/05 and Decree 584/02). Nor is the trafficking or commercialization of cultural goods allowed ( Law 397/97)



    3.8. Anti-Tobacco Law Policy: In accordance with the provisions established in Law 1335 of 2009, our hotel has spaces and environments free of tobacco smoke. Consequently, the guest accepts as an obligation to refrain from smoking in the spaces, areas and environments that are demarcated as smoke-free spaces, as well as in closed spaces, such as rooms, corridors, restaurants, lounges and others. In the event that the guest fails to comply with this obligation, he agrees to pay a penalty equivalent to USD$250 if he smokes in the room or USD$150 if he smokes in the common areas, for breach of his obligations.


    3.9. Authorization Processing of Personal Data: The GUEST authorizes INVERSIONES HOTELERAS ROSALES SA, the operating company of the HOTEL ROSALES PLAZA BOGOTÁ, to process their personal data, which have been delivered through various marketing channels.     3.10. Withdrawal Policy: When you book our services through www.hotelrosalesplaza.com or the Central Reservations, you may exercise the right of withdrawal no later than five business days from the confirmation of purchase. The withdrawal will not proceed for reservations whose entry date is before five days. To withdraw, send an email to reservas.ash@avianethoteles.com if you made your purchase through the website, or contact the Reservations Center if you made your purchase through said channel. The refund of the money will be made without deductions of any kind, by consignment or bank transfer in the name of the holder of the reservation or by reversal to the credit card used for the purchase, depending on the payment method used, within 30 calendar days following the exercise of the retraction.



    3.11. Reversal Policy: When you book our services through www.hotelrosalesplaza.com or the Central Reservations and you have used a credit or debit card or any other electronic payment instrument as a means of payment and the means of payment used is issued by a financial entity domiciled in Colombia, you may request the reversal in case of fraud, unsolicited operation or product purchased not received.

    CHARACTERISTICS:



    The sending of the quote does not imply confirmation of the reservation.



    The confirmation of the reservation is given only when the client is provided with a valid reservation number by the Hotel, either by email or by telephone.



    Our rates include unlimited wired or wireless Internet access, on a maximum of 3 devices per room.



    Rate does not include VAT of 19%. In accordance with (Decree 297 of 2016), any foreigner who visits the country for tourism has the right to accommodation VAT exemption. This exemption applies to foreign passengers not residing in Colombia, presenting their passport stamped PIP-5, PIP 3, PIP-6, PIP-10, TP-7, TP-11 and TP-12 or VISA TP-11 not older than 30 days, which ratifies the passenger as a Tourist or who enters the national territory for cultural purposes or other events or medical treatments.



    In case of presenting a business seal or any other different from those mentioned, the guest must pay the VAT corresponding to 19% of the confirmed rate for the accommodation directly at the hotel.



    Rate does not include hotel insurance of COP$8,000 per person, per night. If you wish to purchase insurance, this service is optional and must be paid at reception as established in Law 1558 of 2012.

    If you require early check in or late check out, we suggest you check with the Reservations Department for availability or additional charges that may be generated.


    INSTRUCTIONS:



    At the time of check-in, our guests must present their photo ID, issued by an official authority, as a precaution for their own safety. All minors must also carry a valid identification that proves the relationship with the owner of the room.



    WARRANTY POLICY:



    For individual reservations, valid credit card details must be provided at the time of booking.



    For corporate reservations, an email or letter is required in which the reservation is guaranteed and the consumption coverage is indicated.



    CANCELLATION POLICY:



    Cancellation 24 hours in advance has no penalty.



    Cancellation outside the established period or no-show will have a cost equal to the value of the first night and the room is guaranteed until 1:00 p.m., after this time it will be cancelled.



    Please note that a change in the duration or date of your reservation may generate a surcharge on the rate.


    LEGAL:



    At Hotel Rosales Plaza we welcome and promote local and international standards and laws that protect girls, boys and adolescents from exploitation, pornography and sexual tourism. In development of Laws 679 of 2001 and 1336 of 2009, it is noted that exploitation, pornography, sex tourism and other forms of sexual abuse of minors in Colombia are criminally and administratively sanctioned in accordance with current laws.



    It is recalled that the trafficking and commercialization of endangered species is considered illegal in Colombia and is penalized (Resolution 0572 of 2005 and Decree 584 of 2002).



    Colombian Law prohibits and penalizes illegally damaging and commercializing cultural heritage assets. Law 379 of 1997.



    At Hotel Rosales Plaza we support Resolution 1956 of 2008, by which measures are issued in relation to the consumption of cigarettes or tobacco. The fine for smoking in the rooms is USD$250 per day.



    By Colombian legislation, billing is done in Colombian pesos. The exchange rate may vary by day.

    GENERAL CONSIDERATIONS


    Aware of the importance of the protection and good management of the personal information provided by the holders of the information, AVIA SOLUCIONES HOTELERAS, - hereinafter AVIANET, who acts as the person responsible for the information received, has designed this policy and procedures that in together allow us to make appropriate use of your personal data.


    In accordance with the provisions of article 15 of the Political Constitution of Colombia, which develops the fundamental right to habeas data, referring to the right that all citizens have to know, update, rectify the personal data that exists about it in databases and in files of both public and private databases, which is inevitably related to the management and treatment of information that recipients of personal information must take into account. Said right has been developed through the issuance of Statutory Law 1581 of 2012 and Regulatory Decree 1377 of 2013, based on which AVIANET as RESPONSIBLE for the personal data that receives, manages and processes the information and thus proceeds to issue This personal data processing policy, which is made known to the public so that they know how AVIA treats their information. Likewise, through the issuance of this policy, the provisions of literal K of article 17 of the aforementioned law are complied with.


    DEFINITIONS  


    Authorization: Prior, express and informed consent of the data owner to carry out the treatment. This can be written, verbal or through unequivocal conduct that allows a reasonable conclusion that the owner granted authorization.


    Database: It is the organized set of Personal Data that is subject to treatment, electronic or not, whatever the modality of its formation, storage, organization and access.


    Query: Request from the owner of the data or from the persons authorized by it or by law to know the information that rests on it in databases or files.


    Personal data: Any information linked or that can be associated with one or several determined or determinable natural persons. These data are classified as sensitive, public, private and semi-private.


    Sensitive personal data: Information that affects the privacy of the person or whose improper use may generate discrimination, such as those that reveal racial or ethnic origin, political orientation, religious or philosophical convictions, membership of unions, social organizations, human rights or that promotes the interests of any political party or that guarantees the rights and guarantees of opposition political parties, as well as data related to health, sexual life and biometric data (fingerprints, among others).


    For the purposes of this policy, AVIANET warns of the optional nature of the owner of the personal data to provide this type of information in cases in which, eventually, it may be requested.


    Public personal data: It is the data classified as such according to the mandates of the law or the Political Constitution and all those that are not semi-private or private. Among others, the data contained in public documents, public records, official gazettes and bulletins, and duly executed court rulings that are not subject to confidentiality, those relating to the marital status of persons, their profession or trade, and their quality as merchant or public servant. The personal data existing in the commercial register of the Chambers of Commerce are public (Article 26 of the C.Co.).


    Likewise, public data are those that, by virtue of a decision of the owner or a legal mandate, are found in files of free access and consultation. These data can be obtained and offered without any reservation and regardless of whether they refer to general, private or personal information.


    Private personal data: It is the data that due to its intimate or reserved nature is only relevant to the person who owns the data. Examples: merchants' books, private documents, information extracted from home inspection.

      

    Semi-private personal data: Semi-private data is not of an intimate, reserved, or public nature and whose knowledge or disclosure may be of interest not only to its owner but also to a certain sector or group of people or to society in general, such as, among others, data referring to compliance and breach of financial obligations or data relating to relations with social security entities.


    Responsible for the Treatment: Person who by himself or in association with others, decides on the database and/or the treatment of the data.


    Data processor: Person who processes data on behalf of the data controller.


    Being "Authorized" is AVIANET and all the people under its responsibility, who by virtue of the authorization and the Policy have the legitimacy to process the owner's personal data. The Authorized includes the gender of the Authorized.


    "Authorization" or being "Enabled", is the legitimacy that expressly and in writing through a contract or document that acts as such, grants AVIANET to third parties, in compliance with the applicable law, for the processing of personal data, turning such third parties into responsible for the processing of personal data delivered or made available.


    Claim: Request from the owner of the data or the persons authorized by it or by law to correct, update or delete their personal data or when they notice that there is an alleged breach of the data protection regime, according to article Art. 15 of the Law 1581 of 2012.


    Owner of the data: It is the natural person to whom the information refers.


     Treatment: Any operation or set of operations on personal data such as, among others, the collection, storage, use, circulation or deletion of this type of information.


    Transmission: Treatment of personal data that implies the communication of the same within (national transmission) or outside Colombia (international transmission) and whose purpose is to carry out a treatment by the person in charge on behalf of the person in charge.


    Transfer: The transfer of data takes place when the person in charge and/or in charge of the processing of personal data, located in Colombia, sends the information or personal data to a recipient, who in turn is responsible for the treatment and is located inside or outside from the country.


    Procedural requirement: The owner or successor in title may only file a complaint with the Superintendence of Industry and Commerce once the consultation or claim process has been exhausted before the person responsible for the treatment or in charge of the treatment, the foregoing according to Article 16 of Law 1581 of 2012.

    Principle of transparency: In the treatment, the right of the owner to obtain from the person responsible for the treatment, at any time and without restrictions, information about the existence of data that concerns him must be guaranteed.

      

    Principle of access and restricted circulation: The treatment is subject to the limits that derive from the nature of the personal data, the provisions of the law and the Constitution. In this sense, the processing can only be done by persons authorized by the owner and/or by persons provided for by law.


    Security principle: The information subject to Treatment by the Treatment Manager or Treatment Manager referred to in this law, must be handled with the technical, human and administrative measures that are necessary to grant security to the records avoiding their adulteration, unauthorized or fraudulent loss, consultation, use or access.


    Principle of confidentiality: All persons involved in the processing of personal data that are not of a public nature are obliged to guarantee the confidentiality of the information, even after the end of their relationship with any of the tasks that comprise the treatment, and may only Provide or communicate personal data when it corresponds to the development of the activities authorized in this law and in its terms.

    REQUESTS, COMPLAINTS AND CLAIMS
